1.1. This offer is an official proposal by Private Entrepreneur Fedorenko TM (hereinafter referred to as the "Seller") to conclude a purchase and sale agreement for goods remotely, i.e., through the online store, by posting this Public Offer Agreement (hereinafter referred to as the "Agreement") on the Seller's official website https://week.life/ (hereinafter referred to as the "Website" or "Online Store").
1.2. The moment of full and unconditional acceptance by the Buyer of the Seller's offer (acceptance) to conclude an electronic purchase and sale agreement, is considered to be the fact of payment by the Buyer for the order under the terms of this Agreement or the placement of the order, if deferred payment is provided, within the terms and at the prices, specified on the Seller's Website.
1.3. The terms of the public offer agreement are the same for all Buyers, except those, entitled to specific benefits under the law.
2.1. In this offer, unless otherwise required by the context, the following terms have the following meanings:
* "Order" – the selection of specific items from the list of goods specified by the Buyer when placing the order.
* "Online Store" – a means for representing or selling goods, work, or services by completing an electronic transaction on the Internet at https://week.life/. * "Buyer" – a physical person, who has entered into an Agreement with the Seller under the terms outlined below.
* "Seller" – Private Entrepreneur Fedorenko TM (TIN 2722111183).
* "Goods" – models, accessories, components, and accompanying items.
This Agreement governs the purchase and sale of goods in the Online Store, including:
- The Buyer's voluntary selection of goods in the Online Store;
- The independent placement of an order by the Buyer in the Online Store;
- Payment by the Buyer for the order placed in the Online Store;
- Processing and delivery of the order to the Buyer under the terms of this Agreement.
4.1. The Buyer has the right to place an order for any product presented on the Online Store's Website and available in stock.
4.2. Each item can be included in the order in any quantity.
4.3. If the product is out of stock, the Seller’s representative must notify the Buyer (by phone or email).
4.4. If the product is unavailable, the Buyer may replace it with a product of a similar model, refuse the product, or cancel the order.
Prepayment and Cash on Delivery
5.1. Payment is made in the following ways:
Immediately after placing the order, via cashless payment in UAH (Ukrainian hryvnia), including using the Fondy payment system.
Upon receipt of the goods at the branch of the delivery company, in cash, in UAH.
5.2. If the payment does not reach the Seller’s account, the Online Store reserves the right to cancel the order.
5.3. Payment made under the terms of this Agreement but without fulfilling other conditions and/or without providing all the details specified in the Agreement is not considered acceptance of the offer to conclude the Agreement (acceptance) and/or, is considered a violation of the terms of this Agreement, and the payment is deemed improper and subject to return to the person who made it.
6.1. Delivery of goods, purchased in the Online Store, is carried out to the warehouses of delivery companies, where the orders are issued.
6.2. Together with the order, the Buyer is provided with documents, in accordance with the current legislation of Ukraine.
7.1. The Seller is obligated to:
Transfer ownership of the Goods to the Buyer in accordance with the order paid by the Buyer or for which the Buyer must pay under this Agreement.
7.2. The Seller has the right to:
Unilaterally suspend the provision of services under this Agreement in case of violation by the Buyer of the terms of this Agreement.
7.3. The Buyer is obligated to:
- Timely pay for and receive the goods according to the order under the terms of this Agreement.
7.4. The Buyer has the right to:
- Place an order in the Online Store;
- Demand the Seller's compliance with the terms of this Agreement.
8.1. The Parties are responsible for the failure to fulfill or improper fulfillment of the terms of this Agreement in accordance with the procedure provided by this Agreement and the current legislation of Ukraine.
8.2. The Seller is not responsible for the following:
- Changes, made by the manufacturer to the appearance of the Goods;
- Minor discrepancies in the color scheme of the Goods, which may differ from the original Goods due to differences in the color rendering of various computer monitor models;
- The accuracy and truthfulness of the information provided by the Buyer when placing the order;
- Delays and interruptions in the provision of services (processing orders and delivering goods) caused by reasons beyond its control;
- Illegal actions committed by the Buyer using access to the Internet;
- The Buyer’s disclosure of their network identifiers such as IP, MAC address, login, and password to third parties.
8.3. The Buyer, using access to the Internet provided to them, independently bears responsibility for the damage caused by their actions (personally, even if someone else was using their login) to individuals or their property, legal entities, the state, or moral principles of morality.
8.4. In the event of force majeure circumstances, the Parties are released from the fulfillment of the terms of this Agreement. For the purposes of this Agreement, force majeure circumstances are extraordinary, unforeseen events that exclude or objectively hinder the implementation of this Agreement, the occurrence of which the Parties could not foresee and prevent by reasonable means.
8.5. The Parties make every effort to resolve any disputes exclusively through negotiations.
9.1. The Online Store reserves the right to unilaterally make changes to this Agreement, provided that the changes are published in advance on the website https://week.life/.
9.2. The Online Store is created to organize a remote method of selling goods by Private Entrepreneur Fedorenko TM through the Internet.
9.3. The Buyer is responsible for the accuracy of the information provided when placing the order. By accepting the offer (placing an order and subsequently paying for the Goods), the Buyer gives the Seller unconditional consent to the collection, processing, storage, and use of their personal data in accordance with the Privacy Policy and the Law of Ukraine "On the Protection of Personal Data."
9.4. The Buyer’s payment for the order placed in the Online Store means full agreement with the terms of this Agreement and the Privacy Policy.
9.5. The actual date of the electronic agreement between the Parties is the date of acceptance of the terms, in accordance with Article 11 of the Law of Ukraine "On Electronic Commerce."
9.6. The use of the Online Store resource for the preliminary review of the product, as well as for placing an order for the Buyer, is free of charge.
9.7. The information provided by the Buyer is confidential. The Online Store uses information about the Buyer solely for processing orders, sending notifications to the Buyer, delivering goods, conducting settlements, and other purposes.
10.1. The return of goods to the Online Store is carried out in accordance with the current legislation of Ukraine.
10.2. The return of goods to the Online Store is carried out at the Seller's expense.
10.3. При возврате Покупателем товара надлежащего качества, Интернет-магазин возвращает ему уплаченную за товар денежную сумму по факту возврата товара с учетом компенсации расходов Интернет-магазина, связанных с доставкой товара Покупателю.
11.1.Электронный договор считается заключенным с момента получения лицом, направившим предложение, заключить такой договор ответа о принятии этого предложения в порядке, определенном п.1.2 настоящего Договора в соответствии с частью шестой статьи 11 Закона Украины "Об электронной коммерции".
11.2. До окончания срока действия данный Договор может быть расторгнут путем возврата денежных средств по взаимному согласию сторон до момента фактической доставки товара.
11.3. Стороны имеют право расторгнуть настоящий договор в одностороннем порядке в случае невыполнения одной из сторон условий настоящего Договора и в случаях, предусмотренных действующим законодательством Украины.
